ESTATE

I want to buy real estate

Flow of real estate purchase

When purchasing real estate in Malaysia, you must pay a down payment of 10% at the same time as the sales contract.
The remaining self-financing will be paid as an intermediate payment according to the progress of the construction.

If it is used, it will be settled by the deadline specified in the contract.
Basically, in Malaysia, you will sign the loan agreement in the presence of a bank-designated attorney.
If you cannot afford to travel, please contact us.

Even foreigners can purchase real estate with a loan from a financial institution in Malaysia. Mortgage special contracts cannot be included when purchasing real estate in Malaysia.
Therefore, it is important to go from booking to loan application quickly so that you can get a loan consent before the sales contract. The offer letter contains detailed conditions such as interest rates.
If you apply for a loan from a Malaysian bank, an offer letter will be issued once the loan is approved within the bank.

1.Attorney's fees for creating a sales contract

When purchasing a newly developed property (newly built property) from a development company, the developer may bear the legal fees.

2.Stamp duty for real estate registration

Stamp duty will be levied on the higher price by comparing the market price at the time of registration with the purchase price.

3.Cost of applying for a real estate mortgage

If you take out a loan, you will be charged the same amount of legal fees as the above sales contract for the total loan amount. At the same time, stamp duty is levied on the total loan amount.

4.Costs for obtaining a state government agreement

Most states require the agreement of the state government when acquiring the property, but in that case, an attorney's fee of about RM500 to 1,000 will be charged.

5.Fees paid to local real estate agents

Generally, when purchasing a second-hand property, a fee of up to 3% of the total purchase amount is paid to the local real estate agent.

There is usually no fee for purchasing a newly developed property directly from a developer. However, please check with the developer individually as it is case by case depending on the situation of the purchaser.

I want to sell real estate

If you use a real estate agent, you will pay about 2-3% of the selling price as a commission. From April 2007, real estate transfer profit tax (capital gains tax) is exempted if sold five years after purchase. No tax will be levied even if the price of the property rises and a gain on transfer is generated. However, it is not possible for a foreigner to resell it within three years after purchasing it.

Regarding transfer tax and inheritance tax

There are currently no transfer or inheritance taxes in Malaysia. Even if a foreigner buys real estate in Malaysia and transfers or inherits it to a child or relative, there is no tax in Malaysia.
